Terms of Service

1) Acceptance of terms

By accessing or using OptiMach Engineering’s (“OptiMach”, “we”, “us”) website or requesting quotes, you agree to these Terms of Service. If you do not agree, please do not use our site or submit requests.

2) Services

OptiMach provides CNC machining, fabrication, and related manufacturing services. All quotes, lead times, and pricing are subject to verification, material availability, and engineering review. We may refuse or modify a quote if specifications change or material costs fluctuate.

3) Quotes and orders

• Quotes are valid for 15 days unless stated otherwise and are based on the drawings and information provided.
• Acceptance of a quote constitutes an order and agreement to these Terms.
• Lead times begin after receipt of order confirmation, materials, and complete production data.

4) Files and confidentiality

Files submitted for quotation or production are treated as confidential. If you check “NDA required” or a separate NDA is signed, those terms apply. You represent that you have the right to share the uploaded files and that they do not infringe on third-party rights.

5) Pricing and payment

• All prices are in USD unless otherwise specified. Taxes, duties, or shipping costs may apply.
• Payment terms are typically net 30 upon approved credit or prepayment for new customers.
• Unpaid balances may incur late fees or production holds.

6) Shipping and delivery

Delivery times are estimates. OptiMach is not liable for delays caused by suppliers, carriers, or circumstances beyond our control. Title and risk of loss transfer to the buyer upon shipment.

7) Quality and inspection

Parts are inspected to the agreed drawings and tolerances. If a defect is found, you must notify us within 10 business days of receipt. Our liability is limited to replacement or refund of the nonconforming parts at our discretion.

8) Warranties and limitations

Except as expressly stated, all products and services are provided “as is” without warranties of any kind. OptiMach’s total liability will not exceed the amount paid for the specific order in question. We are not responsible for indirect, incidental, or consequential damages.

9) Intellectual property

Customers retain ownership of their designs and drawings. OptiMach retains ownership of process methods, tooling, and internal documentation developed to manufacture the parts unless otherwise agreed in writing.

10) Use of website

You agree not to misuse the website, attempt unauthorized access, or disrupt service operations. We may suspend access for maintenance or misuse at any time.

11) Governing law

These Terms are governed by the laws of the State of California, U.S.A., without regard to conflict of law principles. Disputes shall be handled in the state or federal courts located in California.

12) Modifications

We may update these Terms at any time by posting the revised version on this page. The “Last updated” date will reflect the change. Continued use of our services constitutes acceptance of the new Terms.
